Our collateral was damaged in an accident; not a total loss. We are listed as the lien holder with Progressive Insurance. Progressive wrote the check for repair directly to the debtor. The debtor cashed the check and did not repair the car. I though Ohio Law protected the lien holder and that the check had to be made out in both the debtor and creditors names? Progressive's adjuster said they are not required to put the creditors name on the check. If that is correct, the creditor gets screwed to put it bluntly.

How does auto insurance work for dual residency? Two different states - Same vehicle - Same driver.

My wife and I were involved in hit in run accident almost 2 years ago. The driver came at us going the wrong way on the freeway. He was able to drive away (lifted truck) but a witness did get a license plate #. The were no criminal actions because the witnesses were unable to identify the suspected driver. The owner of the car referred to his attorney and the criminal case did not go to court.

i just had my car total because of a storm, the insurance totaled it and offored me $14000 which was $3000 less than what the pay off amount is. i decided to keep the car and the insurance subtracted the salvage value of $4000. i do have gap insurance, my question is that will Gap still pay the difference since i have decided to keep my car?
