Need advice on possible diminished value claim

I'm in Oklahoma and was rear-ended last year. The at fault driver was uninsured, so my uninsured motorist coverage took care of it. I've already settled the medical with State Farm (they paid my full uninsured motorist coverage of $25k for medical, loss of pay, etc) and they paid for the repair. At first they estimated about $2k in damage to our 2007 Chevy Uplander. When I took it to the repair shop, he said he'd guarantee there would be much more than $2k when he got it apart, and there was. Total repair bill was $8665.

I am trying to find some guidance in making sure I get a fair settlement following an accident with a tractor trailer. Long story short, he rear ended us during a heavy rain on the interstate in Florida while returning home from vacation. The trailer jack knifed and came loose from the cab. We were hit by the cab, then the trailer hit us, partially crushing the back of my suv and the cab then hit the side of my car as well. Fortunately, myself, my husband and my four children survived with only a swollen ankle for me and a sore back for him.

When the hero was taken to one of their certified repair facilities they agreed he repairs are awfull and said be vehicle is unsafe to drive. Now the insurance company isn't doing anything and telling me to fight he dealer. I've already tried and can't make any progress. I need help!!

Warning about STATE FARM

I was rear-ended in my car by an ex-convict. This took place on a medium sized road in Tucker Georgia. At that time, my insurer was STATE FARM. They took my statement and the statement of the ex-con, did no other research, and found me liable for the accident. I finally had my day in court in DeKalb County Georgia. I won. My case was dismissed because the ex-con never showed up.

Be warned, I've never had this problem before and I'm certain that STATE FARM simply found it cheaper to do no research on the accident other than making 2 phone calls.

My 19 yr. old son is a full time college student who resides in our home when he's home from college. He's going to buy a car & we're wondering if we can be sued if he causes injury in an accident if our name is not on the car & if he has his own insurance.
