Ok while backing out of a parking lot a few days ago i backed into someone else's car. I have a big dent in the back of it but all the lights still work and i have still been driving it with no issues other than cosmetic. My Insurance company declared it a total loss because the car is a 2000 even though it's in otherwise good shape.

I am wondering what would be a realistic claim for someone like myself. Upfront, I do all ready have a lawyer working for me. As we know, the words ballpark figure seem to make those lawyers skittish. :o Now before I digress into the lawyer jokes allow me to fill you all in with the details.

Possible Insurance Fraud?

On May 19, 2014 my wife was in an accident that was considered at fault. So far my insurance company has dealt with it no problems and nothing needed from me. But now on August 27 we received a letter stating we owe the other parties insurance 8,000+ dollars. The other party drove their car away with little more then a scratch and on the police report said she was uninjured. In the mail their insurance sent us document containing invoices for the rental, repair shop, medical and previous accidents but it also said that it was a total loss.

Letter regarding failure to cooperate regarding stolen car

On August 8, 2014, our vehicle was stolen from a local water park parking lot. We called the police immediately and alerted our insurance immediately. We have turned in all paperwork as soon as possible and returned all calls made to us same day.

My question regards a certified mailing we received from the company on August 18. The beginning of the second paragraph states "We are writing to inform you that we are unable to complete our investigation at this time because to date you have failed to cooperate with ****** in the investigation of the above-referenced claim.

Totaled Highly Moded Jeep

My 2012 Jeep Wrangler Unlimited was totaled. The other driver has accepted full liability.

I had an additional $4,000 of coverage to pay for the roughly $10k in aftermarket parts.

I need some help deciding what to do next and keep getting different answers.

Should the other insurance company pay all of the additions to my Jeep if I provide receipts?

If not, can I take off the mods and replace with OEM items?

Should I buy the totaled Jeep and take off the add ons and then sell the Jeep as salvage?
