Somehow my ex received ins. for his totaled car and managed to hold onto the wrecked car. He is having it fixed up and plans to sell it. In the meantime, he is driving my sons around in it. Is this safe? legal?

Here's the deal, I have a new Toyota Camry 9 months old with 11000 miles I bought it new. We had a Tornado hit our town last week and a tree fell across it crushing the top down and breaking the weather striping around the sun roof, I had the car moved to a local body repair shop today and was told that they could fix it. They said they would have to cut the top off and weld a new one on it. to do this they will have to strip the interior of the car out and re install it after the top is restored. They only intend to repaint half the car after fixing a dent on the trunk and back fenders.

The buyer changed insurance companies and did not list lien holder. Buyer was in a bankruptcy so could not be contacted reguarding the issue.
